was reversed and he was paroled. yesterday he told police he killed his mother. now, police are going to be giving us more information about this crime this morning and we'll keep you posted. live in vallejo, anne makovec, cbs 5. a man in contra costa county fatally stabbed a burglar in his apartment. pittsburg police say four people are in custody accused of what began as an elaborate plot to scare the man. investigators say the woman was having an extramarital affair and wanted to frighten her husband out of the apartment they shared on east leeland lane. >> she plotted a burglary with her current boyfriend to scare him and persuade him into leaving the residence. >> police say they enlisted three other men to help. it happened tuesday morning. investigators say the husband got know a struggle with one of

the other suspects lindsey. they stabbed lindsey to death in self defense. the woman, boyfriend and two other suspects were arrested. they are eligible for murder charges. governor brown says the state budget deficit has dropped below $2 billion. that doesn't mean he plans a big spending spree. quite the opposite. his budget includes more money for education, thanks to voter- approved tax hikes. but it stresses continued fiscal restraint everywhere else. that means many state services that were cut in recent years will not be restored. hats, gloves, warm coats, maybe even boots. you got to be prepared for a big chill when you go outside this morning. cbs 5 reporter cate caugiran is in san rafael checking the falling temperatures. i see you have a scarf on. >> reporter: i have the scarf, gloves, the boots. i guess i just forgot the hat. i think of a cbs 5 hat somewhere. so i'll make up for that. but, yes, temperatures in the

bay area are dropping. the national weather service tweeted that it dropped 11 degrees in the past 24 hours in santa rosa. here in san rafael, just as cold. we are look at 39 degrees. we could see frost advisories and freeze warnings tonight. this morning, though, the people who have the hard he was time getting up will be those in the east an north bays. temperatures will be in the 50s. cold weather will drop snow along the way in the next few days. >> that's snow. this is snow. we might get a good dusting. >> reporter: this morning, we could see snow showers at 1500 feet in the north bay, 2,000 feet in the diablo range and santa cruz mountains and something really rare, this cold weather system could bring two to three inches in the mountains south of monterey.

look at that. 4 degrees celsius here in san rafael. but don't wore if you're not a cold weather person. we are told it's expected to warm back up monday but for the next few days like michelle said, hat, scarves, boots, the works, just to keep warm. live in san rafael, cate caugiran, cbs 5. >> it's fun, too. you live in the east bay so you will get a nice look at mount diablo with a little snow on it. >> i actually like the snow, elizabeth. i don't mind it. >> you're a denver girl. you're used to real snow. if we see anything out there in the east bay, i don't think it's going to be a whole lot. 2,000 feet or below could get up to 2" of snow. highway 17 or highway 35, it could be treacherous traveling. in the meantime the majority of the bay area seeing scattered showers, moving into the south bay. it was over saratoga but looks

like it's quickly moving out. so once again right now pacifica, millbrae looks okay but our hi-def doppler has been relatively busy this morning tracking those light showers that continue to move inland and will slowly taper off throughout the day. temperatures are on the cool side. we already have those freeze warnings and advisories in effect for tomorrow morning. that's really when we'll see these cool temperatures. so yesterday could have been the warmest day that we'll see over the next week. this is our highs for this afternoon. not too high. upper 40s to very low 50s. here's gianna with traffic. >> thank you. the weather playing a role in your morning commute this morning. a wind advisory in effect for the bay bridge. gusty across the span. be careful this morning. metering lights are off. earlier stalled vehicle has been cleared. we have a live look at 880 at hegenberger. roadwork on 880 is wrapped up.

so far, so good through antioch, slight delays westbound, roadwork also on the eastbound side looking good through the altamont pass. and chain requirements for 80 and 50 this morning. so just a heads up if you are heading to the sierra. back to you guys. >> skiers will love it. thank you. the mother of a missing bay area girl is still searching for closure after learning a bone fragment is not her daughter's. the bone was found in october in a san joaquin county well where several victims of the "speed freak" killers were buried. that bone belongs to a teenager, not michaela garecht. she was 9 when she was kidnapped in hayward back in 1988. former penn state assistant coach jerry sandusky returns to court this morning. he is asking for a new trial. he is serving time for child sexual abuse. sandusky's lawyers complain there were -- they were not given enough time to prepare for the trial because of all the material they received from the brews. the 68-year-old sandusky

maintains his innocence. a silicon valley executive says north crow yeah needs to end itself-imposed isolation. eric schmidt of mountain view- based google says if the country does not allow its citizens to use the internet, it will likely remain behind other nations. >> once the internet starts, citizens in a country can certainly build on top of it. but the government has to do something. >> schmidt made his comments yesterday while returning to the u.s. from a trip to north korea with former new mexico governor bill richardson. the private trip was not sanctioned by the u.s. government. that damage that oil tanker caused to the bay bridge this week is more costly than they first thought. got a picture here that shows the underside of the support column that was hit. another picture showing the scrape mark on the ship and if you look to the far left of your screen, some of the wood from the support beam is actually you can see it there still stuck to the ship. damage to the bridge is now estimated between $2 million and $3 million. an attorney for the pilot

says speculation of pilot error is premature. in a statement he says, "there are many potential causes here such as mechanical failure, faulty navigational devices, unpredictable fog conditions and possibly some other sources." from one boat crash to another, the high speed ferry that crashed into a dock in new york city yesterday had recently been overhauled with new engines and a new propulsion system. something federal investigators will now be checking. one witness says a ferry employee told her, operators were complaining about maneuvering problems with the refurbished vessel. yesterday morning's crash injured dozens of passengers, 11 seriously. president obama expected to nominate his new treasury secretary today. that would be jack lew. he will replace timothy geithner if confirmed by the senate. lew is currently the president's chief of staff. he previously served as the budget director and was an exec tv at citigroup. he has a wild signature. a crazy new signature will actually go on our money now if

the president does get his way. this is how jack lew signs his name. spiral graph central there. the white house says there will be no changes. so start checking your $1 bills in the months to come. >> i don't see one letter in that signature. vice president joe biden is going to hear all sides of the gun control debate. he will meet today with the national rifle association and executives from walmart, one of the nation's biggest gun retailers. the goal is to come up with revised gun laws in response to the recent shooting spree at a connecticut elementary school. >> i don't think anything has touched the heart of the american people so profoundly as seeing those young children not only being shot but riddled with bullets. >> yesterday the vice president met with gun control advocates including a survivor from the mass shooting at virginia tech

canada. anadian well, the clock is ticking for a pack of killer whales trapped by ice in canada. experts from the canadian government are heading to the hudson bay today trying to figure out how to save these whales. about a dozen orcas are taking turn breathing at a small opening in the ice. you can see that there. an ice breaker needs to carve a path, but the nearest crew is too far away. >> wow. >> i know. castro valley man is expected in court today after a

strange discovery in his home. here it is. an alligator named mr. teeth. he was in a plexiglass tank atop a 34-pound back of marijuana. alameda county sheriff's deputies found the gator and the pot when they did a routine probation check on this 32-year- old man. >> initially, they didn't think anything of it. they thought maybe it was fake. and then as they were moving around, it started to move and it became a little more aggressive and that caused great concern for them. >> i can imagine! the gator's owner was taken to jail on drug charges. mr. teeth, by the way, is being treated now over at the oakland zoo. veterinarians say he is very sick so they are trying to nurse him back to health. the great white shark may soon be on california's protected species list. several nonprofit groups have petitioned the state citing two studies that estimate only 338 great whites remain off the west coast. a team of state officials is skeptical about that low number. but on monday they determined there is enough evidence to

protect the species as threatened or endangered. the issue is now in the hands of the state fish & game commission. some of the top players from baseball's steroid era are rejected in the hall of fame voting for the first time. former san francisco giants slugger barry bonds didn't even come close to being voted in on the first ballot. only 36% of the baseball writers in america who voted said that bonds belongs in the hall. that is far short of the 75% required. roger clemens got 37%. sammy sosa got 12%. >> everyone is weighing in on this on facebook and twitter. i have been following it. >> it was all the buzz yesterday. >> oh, i know. everyone has an opinion about it. >> i think eventually they will get in. but first of all, a lot of first -- it takes a while to get in. a lot of guys don't get in on the first round. i think they will be punished for at least 10 years. 5:15. let's check the roads. >> let's do that, gianna. take it away. >> thank you very much. yeah, if you are headed towards the bay bridge this morning, a

wind advisory is in effect. no accidents or stalled vehicles. but it is a bit gusty so use caution. chp didn't indicate when they will cancel that. heads up. everything clear into san francisco no delays on the lower deck, either. live look at conditions westbound 580 towards the dublin interchange near 680. extra volume on the westbound side but overall no problems in that area although we are hearing first reports of a car fire. a vehicle may be fully engulfed westbound 580 in the castro valley area. one lane may be blocked. we'll get more information as that comes in. elsewhere you can see on our maps if you are heading on 4, no delays now. traffic clear into pittsburg towards the eastshore freeway, things look good, as well. altamont pass on the 580 a few brake lights but okay there. earlier morning roadwork on the eastbound side of the dumbarton should be wrapping up. not seeing any delays san mateo bridge also problem-free. and here's a live look at conditions at the golden gate bridge and you can see traffic

cruising as you head into san francisco. that's a look at your morning drive. here's elizabeth with your forecast. >> okay, thank you, gianna. well, we could see snow at the higher elevations. looks like 2,000 feet possibly below especially in the santa cruz mountains. snow is definitely possible. we have a winter weather advisory in effect there. the majority of the bay area seeing dry skies or maybe a few scattered showers. you can see our hi-def doppler working -- we'll zoom down to the south bay. we are seeing scattered showers. we saw it earlier over saratoga and now it's continuing to move inland and heading south. eventually this weather will clear by looks like early afternoon. and then we are left with dry skies looks like for a while actually for the next several days. now behind that front we are going to deal with cool temperatures, colder still by tomorrow morning. think today is cold in wait until tomorrow. we already have freeze warnings and frost advisories in effect. below freezing in lot of spots. this afternoon, we'll struggle

to get out of the upper 40s to low 50s and once again any of the light rain that we're seeing this unsettled weather will quickly clear out leaving us high and dry. high pressure begins to build over the next several days. so pinpoint forecast highs later on today, struggling to get off those 50s. very low 50s. and we do have that freeze warning frost advisories already in effect. they have posted this for the last couple of days for tomorrow morning, 2:00 to 8:00 in time for the morning drive. temperatures in the 20s to low 30s. your forecast over the next several days, unsettled weather out of here by the afternoon. friday, saturday, sunday, and continuing into early next week, we have high pressure building and a drying and warming trend building, as well. that's a check of your forecast. back to you guys >> thank you. some new rules are coming next year with hopes of making sure mortgage borrowers can afford to repay their loans. the consumer financial protection bureau announced the new regulations yesterday. they include a requirement for

lenders to verify and inspect borrowers' financial records. and lenders will mostly be banned from saddling customers with loan payments that total more than 43% of the borrowers' annual income. more layoffs are coming to wall street. morgan stanley is expected to cut 1600 jobs, that's 6% of its workforce. about half those cuts will be in the u.s. the firm's investment banking division will take the biggest hit. just last month, citigroup announced it's laying off 11,000 workers. san francisco's tosca cafe needed an angel and they got one. two-time academy award winner sean penn has been a long-time patron of the north beach bound. tosca has been open for 92 years but the owner is having trouble paying rent and was evicted. the bar was going to close in august. so penn heard that and heard it was going under and he got a group behind three popular new york restaurants to sign a 10- year lease on the property. >> it's really neat that there's a -- you know, there's

captions by: caption colorado comments@captioncolorado.com good morning, it's thursday, january 10. i'm frank mallicoat. >> i'm michelle griego. time now is 5:31. >> you better bundle up! we're in for a few chilly days coming up right here in the bay area. >> oh, yeah. cbs 5 reporter cate caugiran is in san rafael right now where some people could see snow out their windows this morning. can't believe it, cate. >> reporter: i know. well, my photographer did remind me it is january. so hopefully this is just in line with what we're supposed to be having. i want to make note, we have a temperature gauge behind us around pnc about 37 degrees. it dropped 2 degrees just in the past half hour. we're looking at the coldest air of the season now. this is dropping temperatures. and for our winter weather lovers, it's expected to drop snow levels, as well. this morning, we could see snow showers at 1500 feet in the north bay, 2,000 feet in the diablo range and santa cruz mountains and something really unique, this cold weather system could also bring two to three inches in the mountains

of south monterey. and people week spoke to yesterday are embracing the cold weather and everything that comes with it. >> it is fun. it's fun because, you know, i mean i grew up back east and unless i go to tahoe i don't see a lot of snow like back east. and so it's kind of a little magical time. we live in a very magical community. but when we have snow here, it just adds to the beauty. >> reporter: the people who had the hardest time getting out of bed this morning those in the east and north bay, temperatures will be below freezing there. daytime highs will struggle just to get to about 40 or 50. and i want to make note, we could see frost advisories, freeze warnings, tonight or early tomorrow morning. but doesn't worry if you are not a cold weather person. the temperatures are expected to rebounded after the weekend. but for everything weather- related and the expert, let's send things over now to elizabeth wenger in the weather center with more on your forecast. >> thank you, cate. it sounds like the santa cruz mountains, that's where that winter weather advisory is in effect and they could actually get hit with the most snow if we see any at all expecting

possibly one to two inches in the higher elevations as cate said. about 2,000 feet or above. that's what we're looking at right now. so here's a live look at our hi- def doppler. mostly scattered showers out there right now. very light scattered showers. very hit or miss. you will notice we're seeing a heavier cell moving out of san jose actually. it's moving farther south now. earlier it was a little farther inland so maybe scattered showers along the coast. but for the most part, it looks like a lot of the bay area is dry right now and any scattered showerses we're seeing will slowly taper off through the morning and afternoon. so temperatures behind that front, chilly temperatures -- we already have freeze warnings and frost advisories in effect around the bay area. now, for tomorrow morning. so if you think this is cold, just wait until around this time tomorrow. temperatures will be in the upper 20s in some spots. so right now we're generally speaking above freezing. not the case in santa rosa, hovering right there at 32

degrees. but it is going to stay cool even into the afternoon struggling to get out of the upper 40s in some spots to just about 50 degrees. so we'll show you a look at those overnight temperatures plus a look at your seven-day forecast coming up. in the meantime, let's hit the roads with gianna. >> traffic is heating up in castro valley. we have this vehicle fire that's really slowing traffic down. you can see that red and yellow here on our maps so speeds under 25 miles per hour. west 580 at castro valley boulevard at one point this vehicle was fully engulfed. this car fire, the right lane has been shut down by chp. so there's lots of activity on the scene. fire crews are there. again this may be a mess to mop up. we'll keep you updated but in the meantime there are delays through there so avoid it if you can or stick to the left if you plan on taking 580 since the right lane is shut down. mass transit is right on time. no delays to report for bart, ace, muni, caltrain and ferries. your south bay commute through milpitas is looking good 880/237. no delays on 101 through san jose or 280. now, let's check conditions along highway 17. we have a photographer standing

by near the summit and, you know, so far traffic is still very light but we're keeping a close eye on this area because of the precipitation in the area and the cold temperatures. there will be reports of black ice maybe a possibility. we will continue to keep you posted on that. back to you. >> a former death row inmate on parole is now under arrest again accused of killing his own mother. cbs 5 reporter anne makovec is in vallejo where the man called police with a confession. anne, good morning. >> reporter: yeah. police say he admitted to killing his mother. he is in jail this morning. here's his picture. dennis stanworth, 70 years old. police say that he called them just before noon yesterday to say he had just killed his 89- year-old mother nelly stanworth in a home on the 2500 block of marshfield road in vallejo. dennis has a long and violent criminal history including kidnapping, sexually assaulting and killing two teenaged girls in contra costa county back in

the '60s. he was sentenced to death for that. but his sentence was reversed. and he was freed. again, police say he just admitted to killing his mother. police will tell us more about this crim later on this morning and we'll keep you posted. live in vallejo, anne makovec, cbs 5. all right, anne, thank you. in contra costa county, there's much more to the story after a man killed a suspected burglar in his apartment. four people are now in custody accused of what pittsburg police say began as a plot and ended in homicide. investigators say charmaine taijeron set it up to frighten her husband out of their apartment. police say taijeron and her boyfriend enlisted three other men to help. investigators say the husband stabbed one suspect in self- defense. taijeron, her boyfriend and the two other suspects were later arrested all three facing murder charges. meantime, the man suspected

of setting his girlfriend on fire in san francisco is due to be arraigned this afternoon. dexter oliver was arrested monday. investigators say he doused the woman with a flammable liquid before lighting her on fire outside a laundromat. the victim, starr lamar, is still being treated for life- threatening injuries at a local burn center a monterey county inmate is missing this morning. deputies are looking for james rim buy. the salinas county work inmate was last seen yesterday running to the soccer fields at navidad creek park. the 29-year-old was serving a three-year sentence for burglary. the mom of a missing bay area girl is still searching for closure after learning a bone fragment is not that of her daughter. the bone was found in october in a san joaquin county well. several victims of the "speed freak" killers are buried there. it turns out that bone belonged to a teenager not michaela garecht. michaela was only 9 years old when she was kidnapped in hayward back in 1988. after three days of digging
